The Wage Act's Five-Item Paystub Rule

Under the Wage Act, M.G.L. c. 149, § 148, a pay statement has to carry the name of the employer and the worker, the date of payment given as month, day and year, the number of hours worked during the pay period, the hourly rate, and all deductions and increases made during that period. An employer cannot charge a worker for a paystub, and an electronic one counts only if the worker can print the information for free. Complaints about unpaid wages go to the Attorney General's Fair Labor Division, which runs the Fair Labor Hotline and takes non-payment claims directly. Payroll records must be kept for three years, and workers have the right to see their own at reasonable times and places.

Form M-4 and the Paid Family Leave Deduction

Two state-level lines sit alongside federal tax. The first is income tax withholding, run by the Department of Revenue: a new hire completes both the federal Form W-4 and a Massachusetts Form M-4, because the state kept its own personal exemptions after the 2017 federal tax law set the federal ones to zero. The second is the Paid Family and Medical Leave contribution, which employers withhold from paychecks and remit under the program the Department of Family and Medical Leave administers. Whether the employer also owes a contribution of its own depends on the size of its covered workforce. Which earnings count follows the definition in the state unemployment statute, c. 151A.

Frequently asked questions

When does my final paycheck have to arrive in Massachusetts?

It depends on how the job ended. A worker who is fired or laid off must be paid in full on their last day of work. A worker who quits is paid in full on the next regular payday, or by the first Saturday after quitting if the employer has no regular payday. Hourly workers are otherwise paid weekly or every two weeks, with the deadline set by how many days they worked in the calendar week.

Can my employer deduct the cost of supplies or a uniform from my pay?

No. The Attorney General's guidance is that an employer cannot take money from a worker's pay for its own ordinary business costs, such as supplies, materials or tools needed for the job. An employer that requires a worker to buy or rent a uniform must pay for it or promptly refund the actual cost. Other deductions are limited to those the law allows, such as tax withholding, or ones the worker asked for to their own benefit.

Is a generated draft an employer-issued pay statement in Massachusetts?

No. A generated draft can help organize genuine payroll information, but it does not verify employment or income and does not replace a statement issued by an employer or payroll provider.

Where should I verify Massachusetts payroll deductions?

Check the current instructions from the IRS and the relevant Massachusetts tax and labor agencies. The calculator provides estimates from the information entered; local taxes, special programs, filing status, and payroll circumstances can change the result.

What records should an independent contractor keep in Massachusetts?

Keep invoices, contracts, platform payout statements, bank records, expense records, and Forms 1099 when applicable. A personal earnings draft can support reconciliation, but it should not be presented as an employer-issued pay statement.
