Act 390 and the Retainable Wage Statement
The Payment of Wages and Fringe Benefits Act, Public Act 390 of 1978, gives a worker the right to a retainable pay statement. It must indicate the hours worked, the gross wages paid, an itemization of deductions, and the dates for which the wages are paid. That itemization carries weight, because the same Act prohibits deductions without authorization by law, by a collective bargaining agreement, or by the employee's written consent. Wages must arrive on a regular basis — weekly, bi-weekly, semi-monthly or monthly, with the frequency depending on the occupation — and complaints about non-payment of wages or fringe benefits go to the Wage and Hour program at the Department of Labor and Economic Opportunity.
One State Rate, Plus Twenty-Four City Taxes
Withholding is computed as a single statewide percentage of compensation, applied after personal and dependent exemptions are deducted, which is why a new hire fills in Form MI-W4 on top of the federal W-4. The Department of Treasury publishes the withholding tables and the annual withholding guide. The local layer is what catches people out: twenty-four cities in the state levy taxes related to income. Treasury administers the City of Detroit's tax, with no separate registration for employers already registered for state taxes, while cities including Grand Rapids, Lansing, Flint and Saginaw run their own forms, filing and taxpayer support. A second withholding line on the stub is the visible result.
Frequently asked questions
When is my last Michigan paycheck due after I quit or am fired?
Act 390 gives the same answer either way. Wages earned in the period in which you quit or are discharged are paid on the regular scheduled payday for that period, rather than on your last day at work. The same law requires wages to be paid in cash, check or money order unless you have authorized direct deposit, and it lets an employer recover an overpayment caused by a mathematical or typographical error only under special conditions.
Why does my Michigan stub show a city tax as well as a state tax?
Because your employer has a location in, or does business in, one of the twenty-four Michigan cities that levy taxes related to income. Detroit's is administered by the Michigan Department of Treasury, which needs no separate registration if the business is already registered for state taxes. The other city taxing authorities administer their own forms, filing and payment requirements, so the paperwork differs from city to city.
Is a generated draft an employer-issued pay statement in Michigan?
No. A generated draft can help organize genuine payroll information, but it does not verify employment or income and does not replace a statement issued by an employer or payroll provider.
Where should I verify Michigan payroll deductions?
Check the current instructions from the IRS and the relevant Michigan tax and labor agencies. The calculator provides estimates from the information entered; local taxes, special programs, filing status, and payroll circumstances can change the result.
What records should an independent contractor keep in Michigan?
Keep invoices, contracts, platform payout statements, bank records, expense records, and Forms 1099 when applicable. A personal earnings draft can support reconciliation, but it should not be presented as an employer-issued pay statement.
