Four Items a Vermont Wage Statement Must Carry
The Department of Labor puts it plainly in its summary of state wage and hour laws: an employer must provide a wage statement with each payment of wages, setting out at a minimum the total hours worked, the hourly rate, gross pay, and each deduction fully itemised. The timing comes from 21 V.S.A. Section 342, which has wages paid each week, covering work to a day not more than six days before the payment date; an employer may shift to biweekly or semimonthly only after giving notice to each employee. Section 393 requires a true and accurate record of hours worked and wages paid, open to the Commissioner. The Wage and Hour Program handles complaints.
Vermont's Optional W-4VT and the Child Care Contribution
Two things shape the state side of a check here. The first is a withholding certificate of Vermont's own, Form W-4VT. It is not required, but the Department of Taxes encourages employees to complete it, because as federal and Vermont tax laws have changed, withholding set for federal purposes may no longer produce the right Vermont amount. The second is newer. A Child Care Contribution payroll tax is owed by the employer on wages earned in Vermont, and the employer may elect to withhold a capped portion from employee pay or absorb the whole amount itself; anything withheld is reported on the W-2. The Department of Taxes administers both.
Frequently asked questions
What must my Vermont pay stub show?
Four things at minimum, with each payment of wages: total hours worked, the hourly rate, gross pay, and each deduction fully itemised. One deduction is specifically prohibited. An employer may not deduct from an employee's wages any amount to offset the state-mandated Health Care Contribution defined at 21 V.S.A. Section 2003. The Department of Labor's Wage and Hour Program publishes this guidance and answers questions about it.
When is my last Vermont paycheck due?
It turns on how the job ended. Under 21 V.S.A. Section 342(b), an employee who is discharged is paid within seventy-two hours of the discharge, while an employee who voluntarily leaves is paid on the last regular pay day, or on the following Friday if there is no regular pay day. If you are absent on the scheduled payment date you are entitled to payment upon demand. A complaint may be filed within two years of the date the wages were due.
Is a generated draft an employer-issued pay statement in Vermont?
No. A generated draft can help organize genuine payroll information, but it does not verify employment or income and does not replace a statement issued by an employer or payroll provider.
Where should I verify Vermont payroll deductions?
Check the current instructions from the IRS and the relevant Vermont tax and labor agencies. The calculator provides estimates from the information entered; local taxes, special programs, filing status, and payroll circumstances can change the result.
What records should an independent contractor keep in Vermont?
Keep invoices, contracts, platform payout statements, bank records, expense records, and Forms 1099 when applicable. A personal earnings draft can support reconciliation, but it should not be presented as an employer-issued pay statement.
