What Virginia's Payment of Wage Law puts on the stub

Under Va. Code § 40.1-29, an employer must hand every employee a written statement on each regular pay date — by paystub or online accounting — carrying the employer's name and address, the rate of pay, gross wages for the pay period, and the amount and purpose of each deduction. Hours worked belong on it when the worker is paid by the hour, or salaried below the standard salary level set by U.S. Department of Labor regulation. Agricultural, agribusiness and forestry employers supply the statement on request instead. The Payment of Wage Unit inside the Department of Labor and Industry's Labor and Employment Law Division investigates unpaid-wage complaints under that section.

Virginia withholding and who pays for unemployment

State income tax comes out of wages paid in Virginia because Virginia Tax requires an employer paying wages here to deduct and withhold it. The tax itself is imposed on a graduated schedule under Va. Code § 58.1-320, not at one flat rate. You set your exemptions on Form VA-4 when employment begins; file nothing and the employer withholds as though you claimed none. After year end the employer files Form VA-6, the Employer's Annual Summary of Virginia Income Tax Withheld, and sends W-2 data electronically. No line funds unemployment insurance: § 60.2-516 forbids deducting those taxes from wages, leaving the cost with the employer.

Frequently asked questions

Does a Virginia paystub have to show hours worked?

Only sometimes. Section 40.1-29 requires the hours line when you are paid on the basis of hours worked, or when you are salaried below the standard salary level adopted by U.S. Department of Labor regulation. A higher-paid salaried employee can receive a complete statement with no hours on it. Rate of pay, gross wages, and the amount and purpose of every deduction have to appear either way.

How often does Virginia law say I must be paid?

It depends on how your pay is calculated. Section 40.1-29 requires salaried employees to be paid at least once each month, and employees paid on an hourly basis at least once every two weeks or twice in each month. Certain students and higher-earning employees may agree to monthly pay. An employer may pay more frequently than the statutory floor, but not less.

Is a generated draft an employer-issued pay statement in Virginia?

No. A generated draft can help organize genuine payroll information, but it does not verify employment or income and does not replace a statement issued by an employer or payroll provider.

Where should I verify Virginia payroll deductions?

Check the current instructions from the IRS and the relevant Virginia tax and labor agencies. The calculator provides estimates from the information entered; local taxes, special programs, filing status, and payroll circumstances can change the result.

What records should an independent contractor keep in Virginia?

Keep invoices, contracts, platform payout statements, bank records, expense records, and Forms 1099 when applicable. A personal earnings draft can support reconciliation, but it should not be presented as an employer-issued pay statement.
