Delaware Withholding, Paid Leave and the Wilmington Wage Tax
Wages are taxed on a graduated schedule, so withholding steps up through brackets instead of sitting at one rate. The Division of Revenue publishes the tables, and the duty to withhold comes from Title 30, Section 1151, which reaches an employer that maintains an office or transacts business in the state. A federal W-4 can be used, and Delaware issues its own certificates as well, including Form W-4NR, the non-resident withholding computation worksheet. A second state line can appear for Delaware Paid Leave: under Title 19, Section 3705 the employer remains liable for the full contribution but may deduct no more than half of it from the employee. A third belongs to Wilmington. The city's Earned Income Tax, commonly called the City Wage Tax, reaches employees who either reside or work in the city, and comes out of the paycheck where the employer withholds it.
Frequently asked questions
Does a Delaware pay stub have to show hours worked?
Only if you are paid hourly. Section 1108 requires the statement to show total hours for the pay period for employees paid at an hourly rate. For everyone else the required elements are the wages due, the pay period covered, and the total deductions, each one separately specified. The statement can be delivered electronically as long as you can retain it, and you may ask for it on a separate written slip instead.
When is my final paycheck due in Delaware?
Section 1103 makes the wages due on the later of two dates: the next date wages would be paid, through your last day worked, under the employer's regular pay cycle, or three business days after that last day. The rule reads the same whether you quit, were discharged, or were laid off. The Department of Labor administers and enforces this chapter of the Delaware Code.
Is a generated draft an employer-issued pay statement in Delaware?
No. A generated draft can help organize genuine payroll information, but it does not verify employment or income and does not replace a statement issued by an employer or payroll provider.
Where should I verify Delaware payroll deductions?
Check the current instructions from the IRS and the relevant Delaware tax and labor agencies. The calculator provides estimates from the information entered; local taxes, special programs, filing status, and payroll circumstances can change the result.
What records should an independent contractor keep in Delaware?
Keep invoices, contracts, platform payout statements, bank records, expense records, and Forms 1099 when applicable. A personal earnings draft can support reconciliation, but it should not be presented as an employer-issued pay statement.
