Montana Pay Records and the Wage Payment Act

Montana's Wage Payment Act does not spell out a list of line items that must appear on a pay stub the way some states do. The detail sits behind the stub instead. For every employee covered by the state minimum wage law, the Department of Labor and Industry requires the employer to keep the hours worked each workday and each workweek, the regular hourly rate and the length of the pay period, total straight-time earnings, total weekly overtime compensation, every addition to and deduction from earnings, total wages paid each pay period, and the date of payment with the pay period it covers. Those records are what the department's Employment Standards Division works from when a worker files a wage claim.

Montana Withholding and the MW-4

Wages earned here are subject to Montana income tax. The Department of Revenue keeps its own withholding certificate, Form MW-4, the Montana Employee's Withholding Allowance and Exemption Certificate, which an employee completes so the employer can withhold Montana income tax from each paycheck. Withholding runs on a bracketed schedule rather than one flat rate, and the department has rebuilt the calculation so that it closely resembles the federal method instead of relying on Montana-specific allowances. Unemployment insurance is a different matter entirely: it never belongs in the deductions column, because the Unemployment Insurance Division tells employers that taking UI tax out of an employee's wages is against the law.

Frequently asked questions

Does Montana require my employer to give me a pay stub?

State law does not set out a required list of pay-stub line items. It does require your employer to keep payroll records: daily and weekly hours, your regular rate, additions to and deductions from earnings, total wages paid, and the date of payment. Under 39-3-204 MCA wages may not be withheld longer than ten business days after they are due and payable, and where no pay period was established the law presumes a semimonthly one. A wage claim goes to the Department of Labor and Industry within 180 days.

When do I get my final paycheck in Montana?

If you are laid off or discharged, wages are due immediately, unless your employer already had a written personnel policy extending the time, and even then payment cannot go past the next payday for the period in which the separation occurred, or fifteen days, whichever comes first. The same next-payday-or-fifteen-days limit applies when you quit. Both deadlines come from 39-3-205 MCA. If the deadline passes, a wage claim goes to the Department of Labor and Industry within 180 days of the default or delay.

Is a generated draft an employer-issued pay statement in Montana?

No. A generated draft can help organize genuine payroll information, but it does not verify employment or income and does not replace a statement issued by an employer or payroll provider.

Where should I verify Montana payroll deductions?

Check the current instructions from the IRS and the relevant Montana tax and labor agencies. The calculator provides estimates from the information entered; local taxes, special programs, filing status, and payroll circumstances can change the result.

What records should an independent contractor keep in Montana?

Keep invoices, contracts, platform payout statements, bank records, expense records, and Forms 1099 when applicable. A personal earnings draft can support reconciliation, but it should not be presented as an employer-issued pay statement.
