Utah Paydays and the Construction-Trades Pay Statement
Under Utah Code Section 34-28-3, wages are paid at regular intervals in periods no longer than semimonthly, on days the employer designates in advance as the regular payday, and services rendered in a pay period must be paid within ten days of that period closing. A payday falling on a Saturday, Sunday or legal holiday moves to the preceding day. Where a deduction has been made, the employer must furnish a statement on each regular payday showing the total amount of each deduction. Employers licensed under the Utah Construction Trades Licensing Act owe a fuller pay statement: employee name, base rate of pay, pay period dates, hours worked if hourly, each required withholding with its reason, and the total paid.
One Flat Rate, and Who Hears a Wage Dispute
State income tax comes out of wages, but not on a bracket ladder. The State Tax Commission describes a single tax rate for all income levels, so the state line is figured the same way whatever the paycheck. Enforcement of the pay rules belongs to a different agency entirely: the Payment of Wages Act, Utah Code 34-28-1 and following, is administered by the Utah Labor Commission through its Antidiscrimination and Labor Division, whose Wage Claim Unit covers paydays, final paychecks, electronic payroll deposits, lawful deductions, wage disputes and payroll records. Where the amount itself is contested, Section 34-28-6 makes the employer give written notice of what it concedes is due and pay that part without condition.
Frequently asked questions
What has to appear on a Utah pay statement?
It depends on the employer. As a baseline, Section 34-28-3 requires that if a deduction is made from the wages paid, the employer furnish you on each regular payday a statement showing the total amount of each deduction. Construction-trades licensees owe more: their statement must give your name, base rate of pay, the dates of the pay period, hours worked if you are hourly, each state and federal withholding with the reason for it, and the total paid.
How soon is a final paycheck due in Utah?
Much sooner if you are let go than if you quit. Section 34-28-5 makes unpaid wages due immediately on separation and gives the employer twenty-four hours to pay them, satisfied by mailing them postmarked no more than a day after separation, by initiating a direct deposit, or by hand delivery within that window. If you resign without a written contract for a definite period, wages become due on the next regular payday instead.
Is a generated draft an employer-issued pay statement in Utah?
No. A generated draft can help organize genuine payroll information, but it does not verify employment or income and does not replace a statement issued by an employer or payroll provider.
Where should I verify Utah payroll deductions?
Check the current instructions from the IRS and the relevant Utah tax and labor agencies. The calculator provides estimates from the information entered; local taxes, special programs, filing status, and payroll circumstances can change the result.
What records should an independent contractor keep in Utah?
Keep invoices, contracts, platform payout statements, bank records, expense records, and Forms 1099 when applicable. A personal earnings draft can support reconciliation, but it should not be presented as an employer-issued pay statement.
